Terms of Use
Effective Date: March 10, 2026
These Terms of Use (the “Agreement”) are entered into by and between MobileFlow Inc. (“MobileFlow” “we,” “us,” or “our”)—the owner and operator of the Hytch software, website(s), and technology platform (collectively, the “Hytch Platform”)—and you (“User” or “you”). By accessing or using the Hytch Platform, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these Terms, you may not use or access the Hytch Platform.
1. Introduction and Acceptance
1.1 Purpose of the Platform
The Hytch Platform is a geo-social group messaging and coordination platform designed to help small groups plan, decide, move, meet, and remember real-world activities together. Core features may include group threads, plan pins, polls, place-based coordination, time-boxed location-sharing pulses, story or recap features, and other tools that help users coordinate real life in a shared context. The Hytch Platform is not a feed-first social network, not a ride-hailing or dispatch service, and not a platform for continuous ambient tracking. The Hytch Platform helps users track shared rides and potentially earn rewards or incentives for commuting or other travel activities. These rewards may be in the form of points, cash, or other benefits, depending on the specific rules and availability at the time. Because the Hytch Platform verifies trip activity, certain features require the collection and processing of precise location and mobility data from your device (e.g., GPS signals and motion-related device signals). If you do not grant the necessary permissions or if you disable location services, the Platform may be unable to log trips, verify rides, prevent fraud, or determine eligibility for rewards or incentives.
1.2 Binding Agreement
By creating an account, clicking “Accept,” or otherwise indicating your agreement to these Terms, you enter into a binding legal agreement with MobileFlow, Inc.. If you do not agree, you must not use the Hytch Platform.
1.3 Defined Terms
For purposes of these Terms and, where applicable, the Privacy Policy, the following capitalized terms have the meanings set forth below:
- “Action Verification” means any feature, workflow, or system logic used by MobileFlow to determine whether a claimed or expected real-world action or condition appears to have occurred, including but not limited to arrival, dwell, meetup participation, group presence, event attendance, SafeRide completion, or similar outcome-based actions.
- “Aggregated Reporting” means reporting, analytics, dashboards, summaries, or metrics that are combined across multiple users, groups, actions, places, or time periods and are designed not to reveal an individual user’s private message content or raw personal movement history.
- “AI-Assisted Feature” means any feature that uses automated models, machine learning, retrieval systems, ranking systems, or large language models to summarize, suggest, organize, classify, or generate outputs based on user-selected or feature-relevant context within the Hytch Platform.
- “Buddy Group” means a trusted sharing context, subgroup, or audience layer within the Hytch Platform through which a user may share content, stories, plans, memories, or related activity with a narrower set of recipients than a broader public or platform-wide audience.
- “Campaign” means a sponsor-funded, operator-funded, peer-funded, or MobileFlow-funded program with defined rules, eligibility criteria, reward limits, outcome criteria, time windows, or geographic parameters.
- “Carrot” means a time-bound incentive, offer, prompt, or reward opportunity created by a user, sponsor, merchant, venue, operator, or partner that is associated with a real-world action, place, time window, or outcome and may require verification to unlock or redeem.
- “Context” means the surrounding product state relevant to a user action, including a group, thread, plan, place, event, time window, verification flow, sponsor campaign, or other bounded coordination environment within the Hytch Platform.
- “Coordination Data” means data generated through a user’s use of the Hytch Platform to organize or participate in real-world activity, including messages, polls, plan objects, place references, check-ins, recap content, location pulses, settings, and related metadata.
- “Decision-Oriented Notification” means a notification intended to help a group make or complete a coordination decision, such as a plan update, poll reminder, RSVP prompt, arrival prompt, or similar action-oriented alert.
- “Dwell” means a period of time during which a user or device appears, based on available signals, to remain at or near a relevant place, destination, venue, or plan location for a duration that may satisfy feature rules, campaign rules, or verification criteria.
- “Geo-Native Primitive” means a core product object or tool that combines conversation with place and time, including plan pins, place threads, location pulses, arrival confirmations, geofenced carrots, and similar map-native coordination features. The whitepaper describes these as part of the product’s messaging spine rather than as standalone utilities.
- “Group” means a private, semi-private, or otherwise bounded messaging and coordination environment created within the Hytch Platform for communication, planning, sharing, and optional verification among its members.
- “Group Context” means the thread, plan, place, membership, communication, and related settings associated with a user’s participation in a particular Hytch group, thread, or coordination flow.
- “Group Memory” means a place-linked, thread-linked, or group-linked record of prior activity, such as stories, recaps, pins, photos, comments, or associated artifacts that help a group remember what it did and inform future coordination.
- “Group Messaging Backend” means the technical infrastructure that powers group threads, delivery, pinned action objects, location-linked interactions, and related coordination features within the Hytch Platform.
- “Group-Scoped Visibility” means a product rule, privacy setting, or default behavior under which content, signals, presence, or location information is limited to a defined group, thread, invite context, or other bounded audience rather than exposed publicly or platform-wide. This is central to the privacy posture described in the whitepaper.
- “Hytch Content” means all content, software, interfaces, visual elements, compilations, designs, trademarks, and other materials made available by MobileFlow through the Hytch Platform, excluding User Content.
- “Invite Flow” means any mechanism by which a user creates, sends, receives, accepts, or declines an invitation to join a Group, thread, campaign, place context, or other Hytch experience.
- “Location Pulse” means a user-initiated, time-boxed, revocable sharing of live, recent, or approximate location to a selected group, thread, or feature context for coordination purposes.
- “Merchant” means a business, venue, restaurant, retailer, operator, or other commercial establishment that participates in a Hytch campaign, carrot program, verified outcome program, or place-based promotion.
- “Operator” means a venue operator, program operator, employer, school, nonprofit, municipality, agency, event organizer, or similar third party that administers, funds, oversees, or participates in a Hytch-based program, campaign, or reporting relationship.
- “Outcome” means a real-world event, action, or condition that a Hytch feature or program is intended to encourage, verify, measure, or report, including arrival, dwell, group attendance, off-peak behavior, SafeRide completion, or similar behavior.
- “Outcome Marketplace” means the commercial model under which sponsors, merchants, venues, operators, or partners fund or evaluate verified real-world outcomes rather than attention-based advertising impressions. That language tracks the current whitepaper direction almost word for word, minus the legalese haircut.
- “Personal Data” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual, household, or device, as applicable under law.
- “Place Thread” means a thread, card, conversation object, or related feature linked to a specific place, venue, destination, or pinned location within the Hytch Platform.
- “Plan” means any proposed or active real-world coordination object within the Hytch Platform, including a place, time, invite state, attendee signals, related chat, or associated follow-up activity.
- “Plan Pin” means a pinned plan object, place-and-time marker, or equivalent in-thread coordination object used to anchor discussion and action around a proposed or active plan.
- “Privacy Mode” means any setting, default, or user control that affects how visible a user, their content, their presence, or their location-related signals are within the Hytch Platform, including invisible mode, blur mode, group-only mode, or similar controls.
- “Privacy-Filtered” means processed, limited, masked, bucketed, generalized, or otherwise constrained so as to reduce the disclosure of personally identifying, message-level, or raw trace-level information.
- “Program Sponsor” means any business, venue, nonprofit, agency, school, employer, municipality, operator, or other third party that funds, supports, or participates in a Hytch incentive, reporting, verification, or outcome-based program.
- “Public Story” means content that a user chooses to make visible beyond the default private or group-scoped sharing context, subject to applicable settings, permissions, and feature availability.
- “Qualified Action” means a user action, behavior, or verified outcome that satisfies the rules of a feature, campaign, or program and may result in eligibility for rewards, perks, credits, or similar benefits.
- “Recap” means a summary, memory object, post-plan artifact, or feature-generated or user-generated record reflecting what happened in connection with a plan, place, group action, or related event.
- “Referral Code” means a code, tokenized identifier, URL, NFT-linked mechanism, or similar referral credential used to attribute sign-ups, subscriptions, or reward eligibility under a Hytch referral program.
- “Reward Capacity” means the prepaid, budgeted, or otherwise allocated amount of reward funding available to support campaign-based or program-based incentives, perks, or verified outcome rewards under rules established by MobileFlow or a Program Sponsor. The whitepaper describes this as a program limit rather than a wallet balance.
- “Reward Capacity Pack” means a predefined sponsor-funded or operator-funded package of Reward Capacity purchased or allocated for a campaign, program, or set of outcomes under Hytch rules.
- “SafeRide” means any optional Hytch feature, workflow, or sponsor-funded program intended to support or verify safer transportation decisions, including but not limited to verified sober rides, rides away from nightlife venues, or similar safety-oriented mobility outcomes.
- “Sensitive Context” means a group, event, place, or feature context that MobileFlow designates as requiring heightened privacy, moderation, safety, or access restrictions due to location sensitivity, user vulnerability, regulatory obligations, or abuse risk.
- “Service Provider” means any third party that processes information, hosts infrastructure, provides communication services, supports identity, payments, analytics, moderation, security, mapping, wallets, or otherwise performs services on behalf of MobileFlow.
- “Sponsor Creative” means content, prompts, offers, messages, or associated materials submitted, approved, displayed, or delivered in connection with a sponsor-funded campaign or program.
- “Story Time” means a Hytch feature for creating, attaching, and sharing place-linked story, memory, or recap content within a group, buddy group, or other selected audience context.
- “Thread” means a conversation channel, message stream, or bounded communication layer within the Hytch Platform, whether associated with a Group, Plan, Place, Campaign, or other Context.
- “Time-Boxed” means limited in duration by design, settings, or feature rules so that access, visibility, sharing, verification, or other activity expires automatically after a stated time window or when the relevant context ends.
- “Time Window” means a stated or inferred period during which a plan, carrot, verification flow, campaign, location pulse, or similar feature is active, relevant, eligible, or visible.
- “User Content” means any text, media, messages, comments, polls, stories, photos, videos, links, plan details, place content, location pulses, recaps, or other content created, uploaded, transmitted, stored, or shared by a user through the Hytch Platform.
- “Verification Event” means a system-generated or user-triggered record indicating that a specific real-world outcome or eligibility condition may have occurred, such as arrival, dwell, meetup participation, event attendance, or completion of a SafeRide-related flow.
- “Verification Signals” means device, behavioral, temporal, or contextual inputs used in connection with Action Verification, including but not limited to GPS, approximate location, timestamps, motion-related signals, proximity indicators, check-ins, group context, and anomaly-detection inputs.
- “Venue” means any bar, restaurant, retailer, event space, entertainment location, hospitality location, or other physical place that may be referenced, pinned, verified, or included in a Hytch plan, group interaction, or campaign.
- “Visibility Control” means any user setting, product default, or feature rule that governs who can view a user’s content, group participation, location pulse, presence state, or other signals.
- “Weekly Active Group” or “WAG” means a measurement concept used internally or operationally to describe a Group that meets a defined level of activity during a specified seven-day period. The whitepaper uses Weekly Active Groups as a core product metric.
2. Ownership
2.1 MobileFlow IP
All software, technology, content, logos, trademarks, and other intellectual property related to the Hytch Platform (collectively, “Hytch IP”) are the sole property of MobileFlow, Inc. Unless specifically granted, no license or ownership rights to Hytch IP are transferred to you by these Terms.
2.2 Limited License
Subject to your compliance with this Agreement, MobileFlow grants you a revocable, non-exclusive, non-transferable license to access and use the Hytch Platform for personal, non-commercial purposes.
3. The Hytch Platform
3.1 Platform Services
Messaging is the primary surface of the Hytch Platform. Features related to verification, rewards, sponsor-funded incentives, analytics, or token-enabled settlement are secondary or optional layers that may be enabled only in certain programs, markets, cities, groups, or use cases. MobileFlow may add, remove, or modify such optional layers at any time. The Hytch Platform may allow users to create or join groups, send messages, pin plans, run polls, create place-based threads, post memories or recaps, and share time-boxed location signals with selected recipients. These features are intended to facilitate voluntary coordination among users. MobileFlow does not guarantee that any particular message, plan, meetup, or group action will occur, be completed, or be safe. The Hytch Platform provides a rules engine to track rides and offer potential rewards for Users who engage in commuting or shared travel activities. Hytch itself does not provide any physical transportation services.
3.2 Facilitation Only
Hytch is not a transportation carrier and does not manage or oversee the safety or legality of rides. Any ride-sharing arrangement is made exclusively between the participating Users.
3.3 No Guarantee of Rewards
Rewards, if offered, depend on factors such as sponsor availability, ride verification, and other criteria established by MobileFlow. We do not guarantee any specific reward amount or earning. This disclaimer extends to any digital tokens that may be offered or awarded through the Hytch Platform. The availability, amount, and/or value of any tokens are subject to market forces, smart contract functionality, and other external factors beyond our control. MobileFlow, Inc. makes no representations or warranties regarding the future value of any tokens, the ease of converting tokens into fiat currency, or the continued availability of any particular exchange or marketplace.
3.4 Subscription Services and Payments
Subscription tiers (including monthly, annual, or organizational licenses) may be purchased using either U.S. Dollars or HYTCH tokens, and are subject to recurring billing terms. Users who opt into a paid subscription agree to abide by all applicable usage terms, and acknowledge that subscription fees are non-refundable except where required by law. MobileFlow reserves the right to adjust pricing or feature availability at its sole discretion with advance notice.
3.5 Location Tracking, Device Permissions, and Trip Verification
- Location & Mobility Data. To provide trip logging, ride verification, fraud prevention, geofenced offers, and reward eligibility determinations, the Hytch Platform may collect and process data from your device that may include precise geolocation, trip routes, timestamps, distance traveled, and motion-related device signals.
- Background Collection (If Enabled). Depending on your device settings and permissions, the Hytch Platform may collect location data while the app is open and, if you grant “Always” or similar permissions, while the app is running in the background for the limited purpose of detecting, logging, and verifying trips and preventing fraud. The Hytch Platform does not collect background location unless your device operating system permits it and you have granted the applicable permission.
- No Guarantee of Verification. Trip detection and verification are probabilistic and may be affected by GPS drift, sensor limitations, device settings, battery optimization, network connectivity, or attempts to spoof location. MobileFlow does not guarantee that any trip will be accurately recorded, verified, or deemed eligible for rewards.
- You Control Permissions. You may change location permissions at any time through your device settings. Disabling or limiting location access may reduce functionality, prevent ride verification, and/or make you ineligible for certain rewards.
- No Emergency Services; Not a Safety Device. The Hytch Platform is not an emergency service and is not designed to detect accidents, impairment, or unsafe driving in real time. Do not rely on the Platform for safety-critical decisions.
Location sharing within the Hytch Platform is optional and user-controlled. Where live or recent location-sharing features are available, such features are intended to operate on a time-boxed, revocable, and group-scoped basis. Unless a feature expressly says otherwise, location visibility is limited to the relevant group, thread, or context selected by the user and is not intended to be public by default. The Hytch Platform is not designed to provide passive, always-on social surveillance. Any location access, verification flow, or location pulse is intended to support a specific user action or program purpose, such as coordination, arrival confirmation, dwell verification, SafeRide verification, fraud prevention, or sponsor-funded eligibility checks. Users should not assume that other users can see their location at all times. Where supported, time-boxed location-sharing windows expire automatically after the selected duration or when the relevant coordination context ends. Users may also revoke or disable location permissions through device or in-app settings, subject to the understanding that doing so may reduce functionality or make certain features unavailable.
3.6 Verification
Some Hytch features may allow users, groups, sponsors, venues, or operators to enable optional verification flows intended to confirm whether a user or group completed a real-world action, such as arriving at a place, remaining for a qualifying dwell period, completing a SafeRide flow, participating in an event, or satisfying other eligibility rules. Verification is optional unless expressly required for a feature the user chooses to use. Verification exists to support coordination trust, sponsor accountability, fraud prevention, safety-oriented program design, and eligibility determinations. Verification is not intended to create public visibility into a user’s private movement patterns or to support unrestricted monitoring of a user’s whereabouts. Verification results are based on signals such as device location, timestamps, motion-related signals, proximity logic, check-ins, user actions, and anti-fraud heuristics. These systems are probabilistic and may be affected by device settings, battery conditions, operating system limitations, GPS error, connectivity, venue density, spoofing attempts, or other factors. MobileFlow does not guarantee that any action will be accurately verified.
3.7 Sponsor and Operator Limits
In some cases, businesses, brands, venues, nonprofits, agencies, schools, employers, municipalities, or other partners (“Program Sponsors”) may fund incentives, perks, campaigns, or outcome-based programs on the Hytch Platform. Such programs may be tied to specific times, places, contexts, groups, or verified outcomes. Program Sponsors do not purchase ownership of users, user relationships, or user identity. Except as expressly disclosed for a specific feature or program, Program Sponsors receive only aggregated, de-identified, privacy-filtered, or program-level reporting regarding participation, verification outcomes, eligibility, performance, or campaign effectiveness. Program Sponsors are not entitled to unrestricted access to personal message content, raw movement traces, or continuous location visibility. Sponsor-funded programs, carrots, perks, incentives, SafeRide programs, verification flows, and reporting features may vary by group, market, jurisdiction, sponsor participation, or rollout stage. MobileFlow makes no guarantee that any such feature will be available to any particular user at any particular time.
4. Modification of Terms
We reserve the right to change or update this Agreement at any time. Any material modifications will be posted on our website or otherwise communicated to you. By continuing to use the Hytch Platform after such notification, you agree to be bound by the revised Terms. If you do not agree, you must stop using the Platform.
5. Eligibility
5.1 Minimum Age
You must be at least 16 years old to use the Hytch Platform. If you are under 18, you may only use the Platform under the supervision of a parent or legal guardian.
5.2 Driver Requirements
If you identify as a Driver, you represent and warrant that you have a valid driver’s license and meet all legal requirements to operate a motor vehicle in your jurisdiction.
5.3 Account Suspension
MobileFlow may suspend or terminate your Hytch account at any time if it suspects or determines you have violated these Terms, any applicable law, or if your actions jeopardize other Users or the Platform.
5.4 Additional Requirements for Digital Asset Features:
Certain functionalities of the Hytch Platform that involve digital assets (including tokens) may be subject to identity verification checks (KYC) and Anti-Money Laundering (AML) requirements. By attempting to access these features, you agree to provide accurate and complete information as requested. We reserve the right to limit or prohibit your access to any digital asset functionality if you fail to meet these requirements or if applicable laws in your jurisdiction so mandate.
6. Inactive Accounts and Disputes
6.1 Inactive Accounts
If your account remains inactive for a designated period (e.g., 60 days), MobileFlow may terminate the account and any unclaimed rewards may be forfeited, subject to applicable law.
6.2 Dispute Resolution Between Users
MobileFlow does not mediate or resolve disputes involving reimbursements, cost sharing, or voluntary payments between Users. You must resolve such issues independently.
7. Communications and Notifications
Users may create, send, upload, post, store, or share content through the Hytch Platform, including messages, images, videos, links, plan details, place references, comments, recaps, and other communications (“User Communications”). Users are solely responsible for their User Communications and for the consequences of sharing them. MobileFlow may provide private or group-scoped messaging environments, but we do not guarantee that any communication environment is risk-free, abuse-free, or error-free. We reserve the right, but not the obligation, to monitor, review, remove, restrict, preserve, or disclose User Communications or related metadata to the extent reasonably necessary to enforce these Terms, investigate abuse, comply with law, protect users, protect the Platform, or maintain service integrity. By creating an account, you agree to receive communications from MobileFlow, such as email, SMS, push notifications, or phone calls. You may opt out of certain promotional messages, but operational messages (e.g., account or ride updates) may be required for Hytch Platform use.
8. Privacy Policy
MobileFlow’s collection and use of your personal information is governed by our Privacy Policy below, which is incorporated by reference. By using the Platform, you acknowledge that you have reviewed our Privacy Policy.
9. Promotions and Referral Programs
Through the Hytch Platform, MobileFlow may offer promotions, discounts, or referral programs at its sole discretion. Such programs may have additional terms, which will be clearly stated. MobileFlow reserves the right to modify or terminate these programs at any time. Referral programs may apply to subscription purchases. If you provide a referral code, you may earn token-based rewards tied to your referees’ ongoing subscription status. MobileFlow may revoke referral benefits at any time due to abuse, fraud, or changes in program structure.
10. Restricted Activities
You agree not to:
- Impersonate any individual or entity.
- Stalk, harass, threaten, or otherwise harm others.
- Violate any local, state, federal, or international law.
- Post false, misleading, defamatory, or obscene content.
- Attempt to artificially claim rides or manipulate the Platform’s reward system.
- Interfere with or disrupt the Hytch Platform’s servers, networks, or security.
- Use the Platform for any unauthorized or illegal purpose.
- use the Hytch Platform to stalk, monitor, intimidate, dox, threaten, coerce, or track another person without their knowledge and authorization;
- pressure, deceive, or manipulate another user into sharing live location, joining a group, confirming arrival, enabling verification, or participating in any sponsor-funded program;
- create or use groups, place threads, stories, recaps, or plan objects for harassment, impersonation, non-consensual surveillance, or targeted abuse;
- scrape, export, infer, reconstruct, or attempt to derive another user’s movement history, home location, routine, or private associations from the Hytch Platform;
- misuse sponsor-funded incentives, carrots, SafeRide flows, or verification tools to fabricate participation, stage false meetups, simulate dwell, or otherwise generate fraudulent eligibility events;
- share another person’s personal information, location details, or private communications without authorization.
- Use referral codes to artificially inflate rewards or manipulate the system through fake or circular subscriptions.
- Use any technique to falsify, obscure, or spoof location or motion data (including GPS spoofing, emulator manipulation, or sensor spoofing) to trigger rewards or misrepresent travel activity.
- Interfere with, disable, or circumvent device permission prompts or operating-system controls intended to inform you of location access.
- Attempt to access, infer, or track another user’s precise location except as explicitly enabled by an in-app feature you are authorized to use.
11. Assumption of Risk
The Hytch Platform may help users coordinate plans, meetups, arrivals, and shared activities, but MobileFlow does not organize, supervise, dispatch, direct, or guarantee such interactions. Any in-person meeting, ride, outing, visit, or group activity arranged through the Platform is undertaken voluntarily and at the sole risk of the participating users. Unless expressly stated for a specific program, MobileFlow does not conduct criminal background checks, identity vetting, sobriety testing, venue screening, or safety certification of users, groups, drivers, riders, hosts, venues, or sponsors, and disclaims any duty to do so. Carpooling involves inherent risks, including personal injury, accidents, or property damage. Users must carry their own insurance covering carpooling activities. MobileFlow does not perform background checks on drivers or riders and is merely a platform facilitating connections. You acknowledge that any chat-based arrangements you make through the Hytch subscription features are at your own risk. MobileFlow does not screen or monitor the content of private messages, and assumes no liability for the actions of any User you may connect with.
12. Termination
This Agreement remains in effect until terminated. MobileFlow may immediately suspend or terminate your account if it believes you have violated these Terms or any law, or for any other reason at its sole discretion. Upon termination, you may lose access to any rewards or services, subject to applicable law.
13. Intellectual Property
All intellectual property rights in and to the Hytch Platform (including any content, software, or designs) remain with MobileFlow, Inc. You may not copy, distribute, modify, or create derivative works of the Platform’s content without express written permission from MobileFlow.
- Disclaimers
- Platform “As Is”: The Hytch Platform is provided on an “as is” and “as available” basis without any warranties, express or implied.
- No Warranty of Safety or Reliability: Hytch does not guarantee that rides arranged via the Platform will be safe, reliable, or free from misconduct.
- No Guaranteed Earnings: Hytch does not warrant that you will earn any specific amount of rewards or that such rewards will be continuous or uninterrupted.
- Location and Data Accuracy: Any GPS or data insights provided by the Platform are approximate and may not be real-time or error-free.
- No Monitoring Obligation: MobileFlow has no obligation to monitor location data for hazards, misconduct, unsafe driving, impairment, or compliance with law, and makes no representation that it will do so.
- No Emergency Services: The Platform does not provide emergency response, roadside assistance, or real-time safety monitoring. If you need emergency assistance, call local emergency services.
- Not a Navigation or Safety Tool: Any insights, trip summaries, or prompts are provided for informational purposes only and must not be used as a substitute for attentive driving, lawful conduct, or independent judgment.
- The Hytch Platform may provide optional AI-assisted features to help summarize plans, suggest next actions, generate recaps, organize group context, or improve coordination. These features may operate by retrieving relevant information from the user’s own group history, active plan objects, place context, or enabled verification events in order to generate contextual outputs.
- AI-assisted features may be incomplete, inaccurate, delayed, biased, or inappropriate for the context. Users remain solely responsible for reviewing AI-generated outputs and for making independent decisions regarding plans, travel, safety, timing, or interactions with others.
- Where AI-assisted features are offered, MobileFlow may use limited contextual inputs from a user’s group or feature context to generate outputs, subject to the Privacy Policy and applicable settings, permissions, and program rules.
- 15. Limitation of Liability
To the fullest extent permitted by law, MobileFlow, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injuries, property damage, data loss, or lost profits from or related to your use of the Hytch Platform. MobileFlow’s total liability is limited to the greater of $100 or the total amount paid by the user in the twelve months preceding the event giving rise to the claim
16. Dispute Resolution and Arbitration
You agree that all disputes arising out of or relating to this Agreement or the Hytch Platform will be resolved exclusively by binding arbitration on an individual basis. Class actions are not permitted. This arbitration provision is governed by the Federal Arbitration Act. Any such arbitration will be conducted by a reputable arbitration organization in a mutually agreed location. If you do not wish to be bound by this arbitration agreement (and you are a Driver), you may opt out by following the procedure stated during account registration or within thirty (30) days of first agreeing to these Terms (if such an option was provided).
17. Indemnity
You agree to defend, indemnify, and hold harmless MobileFlow, Inc. (and its officers, directors, employees, and agents) from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms, your misuse of the Hytch Platform, your violation of any law, or your infringement of any third-party right.
18. Confidentiality
You agree not to disclose any confidential information obtained from the Hytch Platform (e.g., technical data, business strategies, user data) to any third party without MobileFlow’s prior written consent, except where required by law.
19. Relationship with MobileFlow
No partnership, joint venture, employer-employee, or franchisor-franchisee relationship exists between you and MobileFlow by virtue of your use of the Platform or any agreement arising out of these Terms. You are an independent party.
- General Provisions
- Governing Law: These Terms are governed by the laws of the State of Delaware, without regard to conflict of law rules.
2. Assignment: MobileFlow may assign or transfer these Terms, in whole or in part, without restriction. You may not assign or transfer your rights under these Terms without MobileFlow’s written consent.
3. Notices: All notices to Hytch must be sent by email to support@mobileflow.ai.
4. Severability: If any provision of these Terms is held invalid, the remaining provisions remain valid and in effect.
5. No Waiver: A failure by MobileFlow to enforce any right or provision does not constitute a waiver of that right or provision.
- Entire Agreement: These Terms and any referenced policies represent the entire agreement between you and MobileFlow regarding the use of the Platform.
- Blockchain & Third-Party Wallet Integration
- Account Abstraction and Web3Auth
The Hytch Platform may use an account abstraction model for blockchain transactions, including integration through third-party service providers such as Web3Auth. You acknowledge that such services are provided by independent third parties, and MobileFlow, Inc. does not control or guarantee their functionality, security, or availability.
2. Third-Party Services Out of Our Control
To deposit or withdraw digital assets (including tokens), you may be required to use services, websites, or applications owned and operated by third parties. Your interactions with these third parties are solely between you and the third party. MobileFlow, Inc. is not responsible for any losses, fees, or damages arising out of or relating to your use of any third-party service, including fiat on/off ramps, token bridging protocols, or external wallet providers.
3. Security and Private Keys
You are solely responsible for maintaining the security of your private keys, seed phrases, and wallet credentials used in connection with the Hytch Platform. Any unauthorized access or compromise of your wallet(s) or third-party account(s) may result in the loss or theft of digital assets, for which MobileFlow, Inc. disclaims any liability.
4. No Control Over Blockchains
Transactions that take place on public blockchains (or Layer-2 rollups) are confirmed by a decentralized network of independent validators or nodes. MobileFlow, Inc. has no control over such blockchains and cannot undo, reverse, or modify any transaction once it has been recorded on the blockchain.
- KYC, AML, and Identity Verification
- Compliance Obligations
Certain activities on the Hytch Platform—especially those involving the deposit or withdrawal of tokens—may trigger compliance obligations under applicable laws and regulations (including Bank Secrecy Act, USA PATRIOT Act, and other Anti-Money Laundering or ‘AML’ laws). By using these features, you agree to complete all required identity or residency verifications.
2. Disclosure of Information
We may require additional documentation from you (e.g., government-issued ID) to facilitate compliance with these laws. Where legally required, we may share relevant user information with regulatory authorities or other third parties, as set forth in our Privacy Policy.
3. Refusal and Suspension of Service
MobileFlow, Inc. reserves the right to refuse, suspend, or terminate your access to any digital asset functionalities if you fail to comply with our KYC/AML policies or any requests for identity verification. If we deem there is suspicious or fraudulent activity, we may freeze or confiscate digital assets as required or permitted by law.
23. Hytch SafeRide
Hytch SafeRide is an optional feature of the Hytch Platform that allows Users who self-identify as sober drivers to earn incentives for transporting individuals who may be impaired. Hytch SafeRide does not provide transportation services, assign drivers, verify sobriety, or arrange trips. The program provides only (i) trip-logging, (ii) verification mechanics, and (iii) conditional reward eligibility. All transportation decisions remain solely between Users. By opting into Hytch SafeRide, you expressly represent and warrant that:
- You are legally sober under all applicable state and federal laws at the time you begin and complete each trip.
- You are fully capable of safely operating a motor vehicle.
- You alone determine whether you are fit to drive and whether to transport any person.
- You will not participate in SafeRide if you have consumed any substance—legal or illegal—that impairs judgment, reaction time, or driving capability.
This representation is a continuing certification throughout each trip you log under the SafeRide program. Hytch does not:
- Assign passengers,
- Match impaired individuals to sober drivers,
- Instruct a User to drive,
- Recommend or endorse any driver or rider, or
- Verify the condition, sobriety, or intentions of any User.
Any interaction, arrangement, or transport you choose to undertake—even if initiated through Hytch Chat or SafeRide participation—is voluntary and at your sole discretion. Participation in SafeRide does not create any relationship of employment, agency, partnership, joint venture, or transportation-network-company status between you and MobileFlow. You acknowledge that:
- You are not providing transportation on behalf of MobileFlow.
- MobileFlow is not a carrier, broker, dispatcher, or common carrier.
- You receive no wages, commissions, or compensation for driving; incentives are acknowledgments of verified app-logged behavior only.
Users participating in Hytch SafeRide assume full and exclusive responsibility for:
- The operation of their vehicle,
- The safety of any person they voluntarily transport,
- Compliance with all traffic and impaired-driving laws,
- Maintaining appropriate insurance, and
- Determining whether a passenger is safe to transport.
MobileFlow has no responsibility for your vehicle, passengers, trip conditions, or compliance with legal requirements. Users acknowledge that impaired individuals may misrepresent their sobriety or condition. Hytch does not screen or evaluate passengers. You assume all risk associated with transporting any individual. If a User falsely claims sobriety while driving or engages in fraudulent reward-seeking behavior, MobileFlow may:
- Withhold or revoke incentives
- Suspend or terminate the User’s account, and
- Report suspected unlawful conduct to law enforcement as required by law.
MobileFlow does not insure:
- Your vehicle,
- Your trip,
- Your passengers,
- Your fitness to drive, or
- The condition or intentions of any User.
SafeRide incentives are not to be interpreted as a recommendation, instruction, or assurance of safety. To the fullest extent permitted by law, you waive and release MobileFlow from all claims, losses, injuries, damages, liabilities, or disputes arising from or relating to:
- Your decision to operate a vehicle,
- Your representations of sobriety,
- Your transportation of any individual,
- Passenger conduct or misrepresentation,
- Fraud, intoxication, or illegal activity committed by any User.
This waiver supplements, and does not limit, Sections 11 (Assumption of Risk), 14 (Disclaimers), and 15 (Limitation of Liability). You agree to defend, indemnify, and hold harmless MobileFlow from all claims, losses, expenses, damages, or liabilities—including attorneys’ fees—arising from:
- Your participation in SafeRide,
- Your representations of sobriety,
- Your driving or vehicle operation,
- Any injury, property damage, or legal violation connected to a SafeRide trip, or
- Any misrepresentation by you or by a passenger you choose to transport.
SafeRide incentives are conditional and may be denied, adjusted, or revoked at MobileFlow’s sole discretion, including but not limited to circumstances involving:
- Suspected impairment,
- Fraudulent trip-logging,
- Unsafe behavior,
- Violations of law, or
- Misuse of the SafeRide program.
MobileFlow does not guarantee any reward, amount, or continued availability of SafeRide incentives. If transportation coordination occurs through Hytch Chat:
- All communication is User-initiated;
- Hytch does not moderate, direct, or endorse trip planning;
- All meet-ups and rides are at the User’s own risk;
- This section applies fully to any trip arranged or influenced by chat communication.
MobileFlow may suspend or terminate a User’s access to Hytch SafeRide at any time for any violation of these Terms, suspected unsafe conduct, or misrepresentation of sobriety.

You acknowledge and agree that you are solely responsible for understanding and meeting any tax obligations arising from your use of the Hytch Platform, including rewards, tokens, or other benefits. This may include capital gains, income, or other taxes that apply to the acquisition, sale, or exchange of digital assets.

MobileFlow, Inc. does not provide tax advice. If you have questions about your tax obligations, we strongly recommend consulting an accountant or other qualified tax professional.

Digital assets can be volatile, and their value may fluctuate dramatically. There is no guarantee that any tokens you earn or purchase will hold any particular value, nor is there any guarantee that a secondary market for such tokens will exist at any time.”

Blockchain technology and digital assets are subject to rapidly evolving regulatory environments. Regulations may vary significantly by jurisdiction, and changes in laws or regulatory approaches may adversely impact your ability to use, transfer, or trade digital assets.”

You acknowledge the inherent security risks of sending or receiving digital assets over the Internet and that third parties may engage in fraudulent or illegal activity, which could affect the Hytch Platform or your digital assets. MobileFlow, Inc. does not guarantee continuous or uninterrupted access to the Platform and will not be liable for any disruption or downtime.”

1. Introduction
1.1 Purpose of This Policy
We respect your privacy and are committed to responsibly handling your personal information. This Policy describes what information we collect, how we use it, and under what circumstances we share it.
1.2 Scope
This Policy applies to data collected via the Hytch Platform and any related services, applications, or tools that reference this Policy.
1.3 Platform
Hytch is designed as a privacy-preserving geo-social group messaging and coordination platform. Our approach is built around data minimization, group-scoped context, explicit user controls, time-boxed location sharing, and purpose-bound verification. We aim to collect and use only the information reasonably needed to provide messaging, coordination, safety-oriented, verification, anti-fraud, sponsor program, and reporting features.
1.4 Defined Terms
For purposes of these Terms and, where applicable, the Privacy Policy, the following capitalized terms have the meanings set forth below:
- “Action Verification” means any feature, workflow, or system logic used by MobileFlow to determine whether a claimed or expected real-world action or condition appears to have occurred, including but not limited to arrival, dwell, meetup participation, group presence, event attendance, SafeRide completion, or similar outcome-based actions.
- “Aggregated Reporting” means reporting, analytics, dashboards, summaries, or metrics that are combined across multiple users, groups, actions, places, or time periods and are designed not to reveal an individual user’s private message content or raw personal movement history.
- “AI-Assisted Feature” means any feature that uses automated models, machine learning, retrieval systems, ranking systems, or large language models to summarize, suggest, organize, classify, or generate outputs based on user-selected or feature-relevant context within the Hytch Platform.
- “Buddy Group” means a trusted sharing context, subgroup, or audience layer within the Hytch Platform through which a user may share content, stories, plans, memories, or related activity with a narrower set of recipients than a broader public or platform-wide audience.
- “Campaign” means a sponsor-funded, operator-funded, peer-funded, or MobileFlow-funded program with defined rules, eligibility criteria, reward limits, outcome criteria, time windows, or geographic parameters.
- “Carrot” means a time-bound incentive, offer, prompt, or reward opportunity created by a user, sponsor, merchant, venue, operator, or partner that is associated with a real-world action, place, time window, or outcome and may require verification to unlock or redeem.
- “Context” means the surrounding product state relevant to a user action, including a group, thread, plan, place, event, time window, verification flow, sponsor campaign, or other bounded coordination environment within the Hytch Platform.
- “Coordination Data” means data generated through a user’s use of the Hytch Platform to organize or participate in real-world activity, including messages, polls, plan objects, place references, check-ins, recap content, location pulses, settings, and related metadata.
- “Decision-Oriented Notification” means a notification intended to help a group make or complete a coordination decision, such as a plan update, poll reminder, RSVP prompt, arrival prompt, or similar action-oriented alert.
- “Dwell” means a period of time during which a user or device appears, based on available signals, to remain at or near a relevant place, destination, venue, or plan location for a duration that may satisfy feature rules, campaign rules, or verification criteria.
- “Geo-Native Primitive” means a core product object or tool that combines conversation with place and time, including plan pins, place threads, location pulses, arrival confirmations, geofenced carrots, and similar map-native coordination features. The whitepaper describes these as part of the product’s messaging spine rather than as standalone utilities.
- “Group” means a private, semi-private, or otherwise bounded messaging and coordination environment created within the Hytch Platform for communication, planning, sharing, and optional verification among its members.
- “Group Context” means the thread, plan, place, membership, communication, and related settings associated with a user’s participation in a particular Hytch group, thread, or coordination flow.
- “Group Memory” means a place-linked, thread-linked, or group-linked record of prior activity, such as stories, recaps, pins, photos, comments, or associated artifacts that help a group remember what it did and inform future coordination.
- “Group Messaging Backend” means the technical infrastructure that powers group threads, delivery, pinned action objects, location-linked interactions, and related coordination features within the Hytch Platform.
- “Group-Scoped Visibility” means a product rule, privacy setting, or default behavior under which content, signals, presence, or location information is limited to a defined group, thread, invite context, or other bounded audience rather than exposed publicly or platform-wide. This is central to the privacy posture described in the whitepaper.
- “Hytch Content” means all content, software, interfaces, visual elements, compilations, designs, trademarks, and other materials made available by MobileFlow through the Hytch Platform, excluding User Content.
- “Invite Flow” means any mechanism by which a user creates, sends, receives, accepts, or declines an invitation to join a Group, thread, campaign, place context, or other Hytch experience.
- “Location Pulse” means a user-initiated, time-boxed, revocable sharing of live, recent, or approximate location to a selected group, thread, or feature context for coordination purposes.
- “Merchant” means a business, venue, restaurant, retailer, operator, or other commercial establishment that participates in a Hytch campaign, carrot program, verified outcome program, or place-based promotion.
- “Operator” means a venue operator, program operator, employer, school, nonprofit, municipality, agency, event organizer, or similar third party that administers, funds, oversees, or participates in a Hytch-based program, campaign, or reporting relationship.
- “Outcome” means a real-world event, action, or condition that a Hytch feature or program is intended to encourage, verify, measure, or report, including arrival, dwell, group attendance, off-peak behavior, SafeRide completion, or similar behavior.
- “Outcome Marketplace” means the commercial model under which sponsors, merchants, venues, operators, or partners fund or evaluate verified real-world outcomes rather than attention-based advertising impressions. That language tracks the current whitepaper direction almost word for word, minus the legalese haircut.
- “Personal Data” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual, household, or device, as applicable under law.
- “Place Thread” means a thread, card, conversation object, or related feature linked to a specific place, venue, destination, or pinned location within the Hytch Platform.
- “Plan” means any proposed or active real-world coordination object within the Hytch Platform, including a place, time, invite state, attendee signals, related chat, or associated follow-up activity.
- “Plan Pin” means a pinned plan object, place-and-time marker, or equivalent in-thread coordination object used to anchor discussion and action around a proposed or active plan.
- “Privacy Mode” means any setting, default, or user control that affects how visible a user, their content, their presence, or their location-related signals are within the Hytch Platform, including invisible mode, blur mode, group-only mode, or similar controls.
- “Privacy-Filtered” means processed, limited, masked, bucketed, generalized, or otherwise constrained so as to reduce the disclosure of personally identifying, message-level, or raw trace-level information.
- “Program Sponsor” means any business, venue, nonprofit, agency, school, employer, municipality, operator, or other third party that funds, supports, or participates in a Hytch incentive, reporting, verification, or outcome-based program.
- “Public Story” means content that a user chooses to make visible beyond the default private or group-scoped sharing context, subject to applicable settings, permissions, and feature availability.
- “Qualified Action” means a user action, behavior, or verified outcome that satisfies the rules of a feature, campaign, or program and may result in eligibility for rewards, perks, credits, or similar benefits.
- “Recap” means a summary, memory object, post-plan artifact, or feature-generated or user-generated record reflecting what happened in connection with a plan, place, group action, or related event.
- “Referral Code” means a code, tokenized identifier, URL, NFT-linked mechanism, or similar referral credential used to attribute sign-ups, subscriptions, or reward eligibility under a Hytch referral program.
- “Reward Capacity” means the prepaid, budgeted, or otherwise allocated amount of reward funding available to support campaign-based or program-based incentives, perks, or verified outcome rewards under rules established by MobileFlow or a Program Sponsor. The whitepaper describes this as a program limit rather than a wallet balance.
- “Reward Capacity Pack” means a predefined sponsor-funded or operator-funded package of Reward Capacity purchased or allocated for a campaign, program, or set of outcomes under Hytch rules.
- “SafeRide” means any optional Hytch feature, workflow, or sponsor-funded program intended to support or verify safer transportation decisions, including but not limited to verified sober rides, rides away from nightlife venues, or similar safety-oriented mobility outcomes.
- “Sensitive Context” means a group, event, place, or feature context that MobileFlow designates as requiring heightened privacy, moderation, safety, or access restrictions due to location sensitivity, user vulnerability, regulatory obligations, or abuse risk.
- “Service Provider” means any third party that processes information, hosts infrastructure, provides communication services, supports identity, payments, analytics, moderation, security, mapping, wallets, or otherwise performs services on behalf of MobileFlow.
- “Sponsor Creative” means content, prompts, offers, messages, or associated materials submitted, approved, displayed, or delivered in connection with a sponsor-funded campaign or program.
- “Story Time” means a Hytch feature for creating, attaching, and sharing place-linked story, memory, or recap content within a group, buddy group, or other selected audience context.
- “Thread” means a conversation channel, message stream, or bounded communication layer within the Hytch Platform, whether associated with a Group, Plan, Place, Campaign, or other Context.
- “Time-Boxed” means limited in duration by design, settings, or feature rules so that access, visibility, sharing, verification, or other activity expires automatically after a stated time window or when the relevant context ends.
- “Time Window” means a stated or inferred period during which a plan, carrot, verification flow, campaign, location pulse, or similar feature is active, relevant, eligible, or visible.
- “User Content” means any text, media, messages, comments, polls, stories, photos, videos, links, plan details, place content, location pulses, recaps, or other content created, uploaded, transmitted, stored, or shared by a user through the Hytch Platform.
- “Verification Event” means a system-generated or user-triggered record indicating that a specific real-world outcome or eligibility condition may have occurred, such as arrival, dwell, meetup participation, event attendance, or completion of a SafeRide-related flow.
- “Verification Signals” means device, behavioral, temporal, or contextual inputs used in connection with Action Verification, including but not limited to GPS, approximate location, timestamps, motion-related signals, proximity indicators, check-ins, group context, and anomaly-detection inputs.
- “Venue” means any bar, restaurant, retailer, event space, entertainment location, hospitality location, or other physical place that may be referenced, pinned, verified, or included in a Hytch plan, group interaction, or campaign.
- “Visibility Control” means any user setting, product default, or feature rule that governs who can view a user’s content, group participation, location pulse, presence state, or other signals.
- “Weekly Active Group” or “WAG” means a measurement concept used internally or operationally to describe a Group that meets a defined level of activity during a specified seven-day period. The whitepaper uses Weekly Active Groups as a core product metric.
2. Information We Collect
2.1 Group, Messaging, and Coordination Data
We may collect information you create or provide through your use of the Hytch Platform’s coordination and messaging features, including:
- group memberships, group names, thread participation, and invite activity;
- messages, media, links, attachments, reactions, plan details, poll responses, place-thread content, recaps, story or memory content, and other user-generated communications;
- settings or preferences related to notifications, privacy controls, visibility, coordination style, and safety features;
- interaction data related to plan pins, polls, pulses, check-ins, recap flows, or similar coordination objects.
Personal Information We collect information that can identify you personally (“Personal Information”), such as your:
- Name and contact details (e.g., email address, address, phone number)
- Account credentials (e.g., username, password)
- Driver or vehicle details, if you participate as a Driver
- Other information you provide when setting up or using your account
2.2 Usage and Device Information
We collect information about how you access and use the Hytch Platform, including:
- Device details (e.g., operating system, device model, IP address)
- Log data (e.g., access times, pages viewed, in-app actions)
2.3 Location, Verification, Mobility Signals
To support certain features, Hytch may collect and process location-related and mobility-related information from your device. Depending on your permissions, settings, and feature usage, this may include:
- precise geolocation;
- approximate location;
- time-boxed live or recent location shared within a selected group, thread, or context;
- trip or route segments associated with an enabled coordination or verification flow;
- timestamps, distance, heading, speed estimates, proximity events, and motion-related device signals;
- place check-ins, arrivals, dwell events, SafeRide-related movement patterns, and similar verification inputs.
We collect and use this information only for specific product purposes, such as enabling location sharing you choose to activate, supporting plan coordination, confirming arrivals or dwell, administering SafeRide or sponsor-funded programs, improving anti-fraud controls, or generating aggregated reporting. We do not describe Hytch as a continuous ambient tracking service. Where available, live or recent location-sharing features are intended to be time-boxed, revocable, and scoped to the group, thread, or context selected by the user. Location-sharing windows may expire automatically after the selected time period or when the relevant plan or feature ends. If you participate in a feature that includes optional verification, we may collect and process signals needed to determine whether a real-world action appears to have occurred, such as arrival, dwell, meetup participation, event attendance, or completion of a SafeRide-related flow. Verification data may be derived from one or more of the following: location, time, motion-related signals, check-ins, proximity logic, plan context, group context, or anti-fraud models.
2.4 Subscription and Referral Data
When you subscribe to Hytch Chat or use our referral program, we collect billing history, subscription tier, payment method, and applicable referral identifiers (including wallet-linked NFTs). This information is used to manage subscriptions, process payments, distribute token-based referral rewards, and detect abuse or fraud.
2.5 Blockchain and Wallet Information (If Enabled)
If you use digital-asset features, we may collect information associated with your wallet address(es) and blockchain transactions initiated through the Platform (e.g., transaction hashes, timestamps, amounts, and wallet addresses). Please note that public blockchains and Layer-2 networks generally record transactions on a public ledger that may be viewable by others and may be persistent. We do not control public blockchain networks and cannot delete, reverse, or modify on-chain records.
2.6 Messaging Metadata and Service Diagnostics
In addition to message or coordination content, we may collect metadata and technical records associated with messaging and coordination features, such as message timestamps, sender and recipient identifiers, group membership, delivery status, read state, device identifiers, moderation signals, abuse reports, and service-diagnostic logs. We use this information to operate, secure, troubleshoot, and improve the Platform; enforce our Terms; and investigate fraud, abuse, or misuse.
2.7 AI-Assisted Coordination Inputs
If you use AI-assisted coordination features, we may process limited contextual inputs from your group history, plan objects, poll results, place threads, enabled location pulses, or enabled verification events to generate summaries, suggestions, recaps, or other coordination outputs. 3. How We Use Your Information
3.1 Providing, Securing, and Improving the Service
We use personal information and contextual data to:
- create and maintain accounts, groups, and threads;
- deliver messages, media, and notifications;
- enable plan pins, polls, place threads, stories, recaps, and other coordination features;
- honor privacy settings, visibility settings, and time-boxed location-sharing preferences;
- provide optional verification features, including arrival, dwell, meetup, event, or SafeRide confirmation where enabled;
- administer sponsor-funded programs, carrots, perks, promotions, and eligibility rules;
- detect, prevent, investigate, and respond to fraud, abuse, stalking, spoofing, unauthorized tracking, harassment, and other misuse;
- generate aggregated, de-identified, or privacy-filtered analytics and reporting;
- develop and improve product features, safety systems, anti-fraud logic, and AI-assisted coordination features;
- comply with law, enforce our agreements, and protect users, partners, and the public.
3.2 Communications
We may send you transactional or administrative messages (e.g., account updates, ride confirmations). With your consent or as otherwise permitted by law, we may also send promotional communications or surveys. You may opt out of promotional messages at any time.
3.3 Aggregated Mobility and Transportation Data
We do not distribute or sell your individual Personal Information. However, we may create aggregated, de-identified datasets related to mobility and transportation patterns (e.g., trip counts, traffic flow, mileage). These datasets do not identify you personally and may be shared with partners, sponsors, or public agencies to help improve transportation infrastructure, incentivize carpooling, or conduct academic research.
3.4 Sponsor, Partner, and Operator Reporting
When sponsor-funded or partner-funded programs are offered through the Hytch Platform, we may provide sponsors, venues, operators, employers, agencies, schools, municipalities, nonprofits, or similar partners with reporting regarding program performance. Unless otherwise disclosed for a specific feature or required by law, such reporting is intended to be aggregated, de-identified, privacy-filtered, or program-level in nature and may include metrics such as participation counts, verified outcomes, reward utilization, time-window performance, campaign effectiveness, cost per outcome, or similar operational insights. We do not sell unrestricted access to private message content, raw personal movement histories, or continuous user location feeds as part of sponsor reporting.
3.5 Consent, Settings, and Feature Choice
Some Hytch features are optional and rely on your settings, permissions, or active participation, including location sharing, verification, sponsor-funded programs, SafeRide flows, and certain AI-assisted coordination features. Where applicable, we use your permissions, your direct actions, and your feature choices as signals of consent or authorization for the processing reasonably necessary to provide those features.
4. How We Share Your Information
4.1 Third-Party Service Providers
We may share your Personal Information with trusted third parties who perform services on our behalf, such as data hosting, analytics, or customer support. These providers must adhere to confidentiality and data protection requirements consistent with this Policy. We may use third-party platforms to manage chat infrastructure, referral token streaming, or payment processing. These providers are contractually required to protect user data consistent with this Policy. We may use service providers to support hosting, messaging infrastructure, media delivery, analytics, fraud detection, customer support, identity verification, payment processing, safety tooling, mapping, push notifications, blockchain-related services, and AI-assisted features. These providers are authorized to process personal information only as reasonably necessary to perform services for us and subject to contractual restrictions where required.
4.2 Compliance with Law and Safety
We may disclose your information if we believe it is necessary to comply with applicable laws, regulations, or legal processes, or to protect the rights, safety, or property of MobileFlow, Hytch’s users, or the public.
4.3 Business Transactions
In the event of a merger, acquisition, or asset sale, your information may be transferred to the acquiring entity. We will provide notice if your Personal Information becomes subject to a different privacy policy as a result of such a transaction.

5.1 Retention
We retain messaging content, group content, coordination objects, and associated metadata for as long as reasonably necessary to provide the service, maintain user history and group continuity, investigate abuse, resolve disputes, enforce our terms, and comply with legal obligations, unless a shorter retention period is specified for a particular feature. High-sensitivity location signals, recent location-sharing data, and high-resolution verification inputs may be retained for shorter periods than general account records where reasonably feasible, except where longer retention is needed for fraud review, legal compliance, abuse investigation, sponsor-program disputes, safety incidents, or enforcement. We may retain aggregated, de-identified, or privacy-filtered data for longer periods because it is intended not to identify you personally and may be used for analytics, reporting, product improvement, transportation insights, sponsor program evaluation, or research. We retain information for as long as reasonably necessary to provide the Hytch Platform, comply with law, resolve disputes, and enforce our agreements. In general: 1. Raw precise location and high-resolution trip signals: typically retained up to thirty (30) days, unless a longer period is necessary for fraud investigation, dispute resolution, legal compliance, or enforcement. 2. Trip summaries and reward/eligibility records: typically retained up to twenty-four (24) months to support user history, audits, sponsor/grant reporting, and fraud prevention. 3. Aggregated or de-identified mobility analytics: may be retained longer because they are designed not to identify you. We may anonymize, de-identify, or delete information when it is no longer needed.
5.2 Security Measures
We take reasonable administrative, technical, and physical measures to safeguard your information against loss, theft, unauthorized access, disclosure, alteration, or destruction.
5.3 Chat Privacy & Metadata
Messages sent through the Hytch Chat system are encrypted end-to-end using a secure Matrix protocol. MobileFlow does not retain the contents of your messages after delivery. Metadata such as timestamps, message delivery status, and referral information may be retained for abuse monitoring and service diagnostics, but not shared externally.
6. Your Choices and Rights
6.1 Access and Correction

6.2 Opting Out of Communications
You may opt out of receiving promotional emails or text messages by following the unsubscribe instructions in those communications. Please note that you cannot opt out of certain administrative or transactional messages that are necessary to operate the Hytch Platform.
6.3 Location Services
Most mobile devices allow you to disable location services. Disabling location tracking, however, may limit certain functionalities of the Hytch Platform (e.g., ride logging, mileage-based rewards).
6.4 GDPR and CCPA Compliance
EU-based users have the right to access, rectify, erase, restrict processing, and object to the processing of personal data. California residents have the right to request data access, deletion, and to opt-out of data sales or sharing. Requests can be submitted through provided contact methods below.
6.5 Group, Messaging, and Location Controls
Depending on feature availability, you may be able to control aspects of your Hytch experience through account, device, or in-app settings, including:
- whether location permissions are enabled;
- whether live or recent location sharing is allowed;
- the duration of a location-sharing pulse;
- visibility of your presence within a group or thread;
- whether you participate in optional verification flows;
- notification preferences, quiet hours, and group settings;
- blocking, muting, reporting, invite controls, and similar safety controls.
Disabling certain settings may reduce functionality or make some features unavailable.
6.6 No Sale of Raw Personal Location Trails
We do not position our business as selling raw personal location trails or unrestricted surveillance access. Where we share information externally for sponsor programs, operational reporting, mobility insights, analytics, or partner services, we aim to do so in aggregated, de-identified, privacy-filtered, or otherwise constrained forms appropriate to the purpose and applicable law.
7. Children’s Privacy
The Hytch Platform is not intended for children under the age of 16, and we do not knowingly collect personal information from children under 16. If we learn that we have collected personal information from a child under 16, we will take steps to delete it. If you believe a child under 16 has provided us information, please contact us using the contact information in Section 9.
8. Changes to This Policy
We reserve the right to update this Privacy Policy at any time. Material changes will be posted through the Hytch Platform or otherwise communicated to you.
